GENERAL CONTRACTING CONDITIONS AND USE OF LUGGAGESAFE

PURPOSE

These general conditions regulate the contracting of LuggafeSafe (owned by MASABA KFT) through the website www.myluggagesafe.com as well as their use. Likewise, these conditions regulate the contractual relationship between MASABA KFT (owner of LuggageSafe) and the User who contracts the LuggageSafe storage service.

THE SERVICE

LuggageSafe offers its Users the possibility of hiring a storage space for periods comprising calendar days (within the timetable offered by LuggageSafe).

What kind of storage does LuggageSafe offer?

LuggageSafe offers a secured storage room camera surveilled 24/7 and attended by staff within the opening time. All pieces of luggage, suitcases and bags are labeled and identified, so at any moment we keep under control your deposits.

What can a User place in the storage room?

User can place any of the following items in the storage room: pieces of luggage, suitcases, bagpacks and bags, for other items please ask our staff. At the Section Limits on the Use, forbidden items are explained.

How does a User know whether there are any LuggageSafe storage space available?

Through the web page www.myluggagesafe.com, the User will be able to search the availability of storage on the days required.

How long can the storage be hired for?

The User will be able to hire a storage space for a period of between 1 hour, as a minimum, and 365 calendar days, as a maximum.

When will the User be able to access the luggages and personal belongings?

Access to the storage and the User belongings will be accessible to the User from 10:00 h to 01:00 h every day of the week. The User will not be able to access the storage outside these hours as the premises where they are located will be closed.

Therefore, any user who hires our services for one day must deposit their luggage after 10:00 h and remove it before 01:00 of next day.

Once the luggage has been deposited by the User, is it only possible to access the storage area to remove it?

No, the LuggageSafe service is a storage space hire service. The User will be able to access the storage area and his/her belongings as many times as required during period the rental and within the permitted access timetable (see previous section). Therefore, if the User has forgotten something or needs access to the luggage or bags throughout the day, they will be able to access it without problems, as long as they do so within the User access timetable.

How do I know that nobody else can access my luggage while I am storing it?

We provide a secured and unique identifier for every item deposited at our storage (piece of luggage, suitcase, bag, etc). Only the person with such an identifier will be able to access the storage and claim to collect an item.

How much does it cost to hire the storage service?

The price will be calculated by time and piece. Please check our website or contact us for more updated information. We may offer discounts per volume and length of deposit. If you are looking for a special price for your company or your clients, we are happy to discuss it with you.

The prices shown on the website include 27% VAT and refer to the hire of a piece of luggage (despite its size) per time fraction, being the minimum rental time 1 hour.

How does the service work?

User can book online on our website 24/7 (www.myluggagesafe.com), or within our opening time by phone, email or directly at our storage. The storage room where the items are safely kept is video surveillance 24/7 and staff members are available to attend and control the area during opening time.

In order to book, the User just needs to indicate the number of items that User wants to store, their size and the length of the reservation.

Once the user has a valid booking, just need to come to our storage office, register and pay. In case that additional time would be requested, it would be payable before leaving. When the contract process has been completed, the User will receive confirmation of the contract details, the unique and safe identifier to gain access to the items stored.

The user will then be able to access the stored items by showing the security code provided at the moment of deposit.

Can a User modify or cancel a reservation?

Yes if the modification or cancellation is requested at least 24 hours in advance of the date the reserved service commences.

ACCESS AND RESERVATION

The following requirements must be complied with in order to be able to hire a LuggageSafe storage service.

The User must:

Be 16 years of age or over.

Truthfully and accurately complete the indicated fields in the form provided in the website RESERVATIONS Section or the form provided by our staff members on the spot. Specifically, the following: name and surnames, telephone number, email address, date of reservation, number of hours/days and number of items (indicating the size) required to be stored, payment details depending on the payment method used.

Accept these general conditions for contracting the service and for the use of the storage service.

Accept the privacy policy of MASABA KFT as the owner of the LuggageSafe storage room.

Once the contracting process has been completed, the User will receive confirmation of the reservation by email or text message. This confirmation will indicate the number of items, the number of hours/days reserved and the unique and secure access code.

PERSONAL DATA

Basic information regarding Data Protection

Responsible: MASABA KFT

Purpose: To manage the reservation formalized by the User. To send commercial communications by email (LuggageSafe offers).

Legitimacy: Execution of a contract by formalizing the reservation. Express consent in the case of commercial communications by email.

Recipients: The data will not be communicated to third parties, except under legal obligation.

Rights: Rights of access, rectification, opposition, limitation and cancellation, under the terms detailed in this section.

The form referred to in the previous section, which must be completed by the User, it contains the details that MASABA KFT needs to formalize the hiring of the LuggageSafe storage service by the User, as well as to be able to comply with the contractual obligations that will be derived for the parts of the storage service that the User wishes to hire, where applicable.

The User guarantees that all data regarding their identity, as well as regarding the reservation are truthful, accurate and complete.

The personal details provided will be used to manage the reservation and comply with the obligations derived for the parts of the storage service. MASABA KFT is entitled to process the personal details provided in the contracting process as necessary for the provision of the service. The User, when contracting, expressly consents to the processing of their personal details in the terms detailed here.

On the other hand, MASABA KFT will use the User’s personal details and, in particular, their email to send them commercial communications by email about the services offered by MASABA KFT and its commercial offers. If the User does not want to receive commercial communications, they must check the corresponding box during the contracting process. If, however, the User does agree to receive commercial communications by email, MASABA KFT informs them that such consent will be revocable at any time.

The User is informed that there are video surveillance cameras in LuggageSafe premises. The purpose of these cameras is to provide control over the condition of the storage area at all times, as well as the use made by Users or third parties accessing the premises containing the deposited items, with the aim of providing a better service by masaba kft all LuggageSafe premises incorporate the corresponding notices regarding the area under video surveillance, in accordance with current data protection legislation.

The User has the possibility to exercise their rights of access, opposition, limitation, rectification and cancellation of said data, at any time, by requesting it through written communication that identifies them (to which they must attach a copy of their ID or passport) to: MASABA KFT. 1052 Budapest, Piarista utca 4. Floor 2 or to admin@myluggagesafe.com. If, at any time, the User considers that the applicable regulations on data protection have been infringed by MASABA KFT they will be entitled to submit a complaint to the data protection Control Authorities and, in particular, the Hungarian Data Protection Agency.

MASABA KFT does not make international data transfers or take automated decisions about the information provided by the User.

MASABA KFT will keep the User’s personal details for as long as is necessary to provide the service as well as for as long as is necessary to comply with any applicable legal obligation. After this period, their details will be canceled. On the other hand, in any case, MASABA KFT will retain the User’s details until their consent to receive commercial communications by electronic mail is revoked, if it has been given.

USER OBLIGATIONS LIMITS ON THE USE OF THE STORAGE SERVICE

When contracting the LuggageSafe storage services, the User undertakes in particular and without limitation to:

Users are hiring the storage area for the sole purpose of depositing their property, which they temporarily need to keep in a safe place.

Diligently use the storage area and, in particular, respecting the premises and items of other Users.

Not use the storage area to store big items such as bycicles.

Not use the storage area for illegal or unauthorized purposes. In particular, the User undertakes to not store objects whose mere possession or trafficking is illegal (such as stolen objects, drugs, pornographic materials or those that are in any way denigrating for human beings, etc.).

Not deposit any property whose possession requires a license without said license or authorisation (such as, for example, weapons).

Not insert in the storage area any type of material that is polluting or dangerous (such as flammable objects or dangerous substances).

Not use the storage area to deposit animals or any kind of living being

Not insert food, except for packaged food that cannot spill, stain the storage area or produce odors of any kind in the LuggageSafe premises. In case of deposits of less than 24h, the storage of edible goods is possible always under the responsibility and sole risk of the User, MASABA KFT does not take any responsibility on damages on food or similar goods which are deposited.

Not provide their security code to any third party, being fully responsible for the breach of this obligation and its consequences. In case the User suspects that the security code has been compromised or lost, should inform LuggageSafe immediately. MASABA KFT does not take any responsibility for items that are taken off by using the security code.

Not use the storage area to deposit goods to be collected by a third party. Not only the storage area but also the entire area must not be used as a means of trafficking goods between parties. MASABA KFT does not authorize this use.

Access the premises and remain there for the sole purpose of accessing the hired storage space and only to carry out specific actions in relation to the item inserted. The User may not remain on the premises for longer than is strictly necessary.

Not eat or drink beverages within the premises.

Remove the item stored before the hired time ends. Note that in case of delays, special rates and/or penalties are applicable.

Leave the storage area, at the end of the service, in the same condition in which it was found and, in particular, to notify LuggageSafe through hello@mylugaggesafe.com of any incident that the User may find in their use of the service or relating to the condition of the premises.

Not take photographs or videos within the LuggageSafe premises and, in particular and without limitation, to not take photographs or recordings of the security measures in the premises.

Not to place in the storage room money, jewelry, technological items (tablets, computers, televisions, etc.) or goods of special value. It is the User’s sole and exclusive responsibility to use the hired service to store any type of goods of special value. MASABA KFT does not take responsibility for items inside of luggage, suitcases, bags or any other recipient.

CONSEQUENCES AND LIABILITY OF THE USER IN CASE OF BREACH OF OBLIGATIONS

The User must keep MASABA KFT indemnified for the damages arising from the breach of the obligations relating to this present contract.

Non-compliance with the rental period

In particular, if the User does not collect the deposited items on or before the expiry date for the rented service, MASABA KFT will be authorized to access the storage area to remove the stored items, in order to release the space and allow it to be used by MASABA KFT customers. Under these circumstances, MASABA KFT will temporarily store the item and try to contact the User who has failed to comply with the hire period deadline, in order to manage the return of the luggage to the User (the cost of which will be borne 100% by the User including and not limited to, a 30 % surcharge in the cost associated with the return). After fifteen days without having been able to contact the User or without the User contacting MASABA KFT and collecting the items, it will be understood that the goods have been abandoned by the User for all purposes. Under these circumstances, MASABA KFT will cease to keep them, disposing of them in the manner it deems appropriate or convenient, depending on the type of abandoned property.

A cost equivalent to the price of the storage time not cleared will be charged for every hour that passes, being applicable the basic hourly fee as a minimum. MASABA KFT keeps the right to modify the mentioned charge of penalty unilaterally and without previous confirmation, until the luggage is delivered to the User or collected by the User. In addition, the User will be charged a penalty of €150 by MASABA KFT irrespective of MASABA KFT’s right to claim the damages actually suffered.

Unless the User personally collects the deposited items, MASABA KFT will manage the transport of the items to the User, following payment for the service to MASABA KFT by the User. In particular, where applicable, the User must pay MASABA KFT €25 per item, when the delivery is made within the national territory and €50 per item, when the delivery must be made outside Hungary. A 30 % surcharge may be applicable over the third party services, such Post or Delivery companies. The delivery will be understood to have taken place from the moment MASABA KFT delivers the items to the carrier, MASABA KFT will not assume any liability for the transport of the items.

The return will be made once MASABA KFT has received payment from the User for the amounts charged for the delivery of the goods (depending on the number of items and their destination) in accordance with the provisions of the preceding paragraph. If 10 calendar days have elapsed since MASABA KFT notified the User in writing of the amount to be paid and the User has not made this payment, it will be understood that the luggage has been abandoned for all purposes by the User and MASABA KFT will proceed nt he terms specified above for abandoned property.

Failure to use the storage premises properly

MASABA KFT reserves the right to remove any object that does not comply with the rules of use of the storage service and premises, and that is a prohibited object. Under these circumstances, MASABA KFT will be authorized to call the police and report the behavior, as well as withdrawing the prohibited objects.

The User will be responsible for the objects placed in the storage.

In any case, the removal of prohibited items will entail a penalty of €150, this penalty will not exclude the non-compliant User from the obligation to indemnify MASABA KFT for the damages and losses actually caused.

Damage caused to the storage premises by the User

The User will be fully responsible for any damage or deterioration that may be caused to the storage premises by their misuse or improper use. Under these circumstances, the User must compensate MASABA KFT for the physical damage caused to the storage premises and for loss of earnings.

In particular and without limitation, the User causing the damage must pay MASABA KFT a daily hire penalty for each day the storage premises are not usable, as well as the cost of repair or replacement, which is quantified at €1.000 (as a minimum), regardless of the damages caused.

Payment of penalties

The penalties detailed in this section will be paid by the User using the same means of payment used by the User when contracting the service or by bank transfer to the account indicated by MASABA KFT if required by the User. The User expressly accepts that MASABA KFT will charge the amounts established in this section using the User’s card or means of payment when contracting the service.

MASABA KFT’S OBLIGATIONS

MASABA KFT undertakes to keep the storage service active and to make it available to the User during the contracted period. Also to keep the storage area that the User has contracted in good condition for use.

In addition, MASABA KFT undertakes to resolve any incident that may arise in the use of the storage service as quickly as possible.

LIMIT OF LIABILITY OF MASABA KFT

MASABA KFT offers a storage space hire service, it is not responsible for the custody of the luggage. The User is solely responsible for the goods included in the hired storage.

Notwithstanding the above, in case of theft, MASABA KFT has taken out an insurance contract in favor of its Users that covers losses due to theft up to a maximum of €1000 per item, always according with the size and characteristics of the deposited item, but never in relation with the belongings inside of it.

This insurance does not cover the loss of money, jewelry, precious stones or metals, watches, plasma screens and in general technological items (cameras, LCD, GPS navigators, cell phones, computers, tablets), art objects, antiques, memory cards or any other medium that contains data or images.

COMPLAINTS

If the User considers they have reason to lodge a complaint, they can do so by sending an email to the following address admin@myluggagesafe.com.

MASABA KFT will try to resolve the incident and seek a solution that satisfies both parties.

APPLICABLE LAW AND JURISDICTION

These General Conditions are governed by Hungarian law. The parties submit to the jurisdiction of Hungary to resolve any dispute arising in connection with this contract.
